What is the AR of theft?
Appropriates property belonging to another
What is the AR of criminal damage?
Destroys or damages property belonging to another, without lawful excuse
What is the AR of murder?
The unlawful killing of a reasonable person in being under the King’s peace

Appropriates property belonging to another
What is the MR for theft?
Dishonesty and intention to permanently deprive
What is the MR for criminal damage?
Intention or recklessness as to causing damage

Intention to kill or cause GBH

Dishonesty, intention to permanently deprive and intention to use force in order to steal
What is required for the AR for fraud by false representation?
A representation is false if:
- it is untrue or misleading
‘Representation’ means any representation as to fact or law, including representation as to the state of mind of:
- the person making the representation
- any other person
A representation may be express or implied
What is required for the MR for fraud by false representation?
- Dishonesty
- MR for the false representation - D must know, or be aware, that the statement is untrue or misleading
- Intention to make a gain or cause a loss
