What is an attempt?
Defined In S1 criminal attempts act 1981
An attempt to commit an offence and doing more than merely preparatory as to the commission of the crime.
What is the actus reas of an attempt?
When the defendant does anything that’s more than merely preparatory towards the commission of the offence.
What is the Mens rea of attempt?
The defendant must have intention to commit the full crime.
Cannot be reckless.
What is article 5(1)?
Everyone has the right to liberty and security of person and No one shall be deprived of their liberty.
What is s5(1)(a)?
The lawful detention of a person after conviction by a competent court
What is Article 2: Right to life?
Where everyone’s right to life shall be protected by law.
No one shall be deprived of his life intentionally save in the execution of a sentence of a court following his conviction of a crime for which this penalty is provided by law.
