Why is automatism a defence?
Because the actus reus was involuntary and the defendant didn’t have the required mens rea (there was a total loss of control)

AG Ref No.2 1992 (a lorry driver crashed and killed two people - claimed he had lost control but there was evidence he was partially in control)

They can for specific intent offences (as long as they didn’t form the mens rea) but they can’t use it for basic intent offences
