Premarital Agreements
A
- Parties can agree to the disposition of PROPERTY at divorce and to ALIMONY
- Courts CANNOT be bound by provisions in the agreement regarding CHILDREN
- Req. for VALIDITY: MUST be in WRITING and SIGNED. Entered into VOLUNTARILY. Full DISCLOSURE of assets or proof that party had indep. knowledge
- Can agree on state law to apply; or just most sig. relationship
