3 objectives of our U.S. tort system
provide compensation to victims
prevent future harms and losses
require the wrongdoer to provide compensation to the victim
For any action to be a tort, it must meet ALL of the following criteria
Duty - obligation (ethical or legal)
Breach
Causation
Damages
if the duty aspect of a tort is missing, the victim will still receive compensation
false, duty must be included in the criteria in order for it to be considered a tort
punitive damages
extra damages, over and above compensatory damages, awarded against the wrongdoer for their wicked and reprehensible conduct (graduation example)
punitive damages also include what:
additional money from the wrongdoer to the victim
true or false, punitive damages are awarded in contract cases
false, punitive damages are only allowed to be awarded in tort cases
battery
intentional harmful or offensive bodily contact (workplace handshake example)
assault
conduct that places someone in imminent fear of a battery
if i swing and hit you in the face and you duck is it assault, battery, or both
assault only, because you saw the punch coming which allowed you to duck and therefore, no contact was made
if i swang and punched you in the back of the head while you were walking down the street is that battery, assault, or both
both because you harmed me with the intent to harm me, and i was not aware that you were about to harm me because you came up behind me

all are civil
false imprisonment
confining someone against their will and they are either harmed by it or aware of it
false in false imprisonment does not mean untrue… it means
bad
