prohibition
- no person may operate a body modification establishment or perform a body modification except in compliance with the provisions of this by law
- no body modification establishment or any person performing a body modification may insert any implant or perform any scarification on any person
licensing
no person may commence the operation of a body modification establishment without obtaining a permit from the public healther inspector
(cannot be transferred to another person, must be renewed annually)
no person may perform body modification witihout a certificate from a public health inspector
premises
every body modification eestablishment must:
- be located in a building
- be separated by solid partitions from any area used for living, dining or sleeping
- have a reception area
- have a work station
- have an adequate supply of hot and cold water at all times
- have toilet facilities
- have artificial light
- be well ventilated
- have walls, floors and ceilings
- and a cleaning and sterilization room
- prohibit animals in the premises
premises (work station)
- have an easily accesible hand basin with hot and cold running water
- have floors, walls and ceilings
- minimum 50 square feet
- have cabinets, tables and other furniture constructed of durable and easily cleanable material
- have sufficient storage
- have at least on covered waste receptacle
- be separated from any work station by a partition wall
- be sanitized after each use
- have sharps container
- have door at the entrance
- not be carpeted
body modification technician practice and procedures
every body modification tech must:
- wear new disposable medical gloves during each body modification which must be discarded after each body modification
- ensure that any product applied or used on the skin is single use and is disposed
- ensure that any product or instrument which becomes contaminated by other than the body modification procedure is immediately replaced
- perform a body modification only in a work station
- not engage or perform a body modification if the tech has a communicable disease
- maintain a high degree of personal hygiene
- wear clean outer garments when
- thoroughly wash their hands and exposed portions of their arms with liquid soap and hot running water
- not use an ear piercing gun except on the lobe of the ear
what must you ensure prior to commencing a body modification
ensure:
- the skin surrounding the site of the body modification is free of any rash or breaks in the skin and is washed with soap and water
- where shaving is necessary, use a single use disposable razor
- client must not be under the influence of drugs or alcohol
- client must be over the age of 18, or is accompanied by a parent or guardian
what must you advise each person on whom a body modification is to be performed that the following conditions may pose a risk
- diabetes
- skin sensitivities to soap, disinfectants, pigmenets or dyes
- history of haemophilia or bleeding
- use of medications such as blood thinners
by laws with tattoo pgiments
must ensure that:
- pigments are pbtained from a licensed commercial manufacturere or supplier
- pour any pigments in a body modification into a single use container
- ensure that no smoking, eating, or drinking occurs in the work station area
- wash the completed tattoo with sterile gauze or cotton which has been saturated with tincture of green soap or equivalent
equipment, supplies and instruments
- all instruments must be sterilized prior to use
- no cleansing or sterilization may take place except within the cleaning and sterilizing room
- prior to sterilizing all instruments must be packed individually in packages, and must be opened in front of a customer
- all sterilized equipment and instruments must be stored so as to prevent contamination
- must have a monthly spore detection test performed on any autoclave
- exterior of all equipment must be kept in sanitary condition
waste disposal
- any waste which contains any blood, skin or bodily fluids must be placed in plastic garbage bags
- all sharps must be handled and disposed of in accordance with the biomedical waste sharps by-law as amended from time to time
- all waste receptacles must be emptied daily
records
every operator must maintain on the premises an accurate, complete and up to date record in a bound volume with numbered pages:
- each transaction with every client, including the clients name, address, phone number, date of birth, the date, time and nature of the procedure performed and copies of any information or consents given to or by the client and techs name
- have eevery employees name, date of birth, address and home phone number
enforcement
a public health inspector may conduct inspections to take steps to enforce bylaws
responsibility
the owner, operator or person in charge of a body modification establishment must comply with the terms of by-laws and are liable for contravention, breach or failure to obey any of the provisions
inspections
public health inspector may enter any body modification establishment for the purpose of making inspections
orders
public health inspector may serve an order on the person in charge to correct violations listed in or attached to the order within the period specified
penalty
a person or corporation who contravenes a provision of the bby law is guilty of an offence
is liable with:
- first offence is a fine of $100.00 for an individual and $500.00 for corporations or partnerships
- second offence is $200.00 (individual) or $700.00 (corp)
- third offence is $300.00 (individual) or $1000.00 (corp)
can also be convicted of imprisonment for a term not exceeding 6 months or a fine of $1000.00 or both
