What is the first component of a Declaration of Professional services?
(Declaration of Professional Practice and Procedures)

A

Areas of expertise: informing your client, or better yet your prospective client, about who you are and your credentials. The client should know some basic academic information about you, where you got your degree, the field in which you earned a degree, and the specific degree. Number of years practicing and what you consider your specialty.

Why do you list “What I do” and “How I work?”

A

“What I do” explains the basis of behavior analysis services, that we work with input from clients and that we develop a plan to acquire new behaviors, and that family members and significant others will play a key role if this is part of the treatment design.

“How I work” spells out that we do not make judgments about behavior and that it is part of our belief system that “psychological” pain and suffering come from behaviors that do not adapt well to the current environment. With permission, we do consult with significant others. We are not interested in changing only behavior per se, but rather we work toward achieving important life goals for the client. ABA is not a “cure,” and we do not guarantee results.

Why list client responsibilities?

A

To clarify what the behavior analyst expects of the client. Buy-in is necessary for ABA success. We need to know information pertaining to medications, alternative treatments, etc. Policies on scheduling should be explained.

What should be done about gifts from clients?

A

The Declaration should make a clear statement on gifts and invitations to dinners, parties, and celebrations. This should include an explanation of how accepting tokens of appreciation can compromise professional judgment and create dual relationships.

What is the Tarasoff case?

A

A case in which the Supreme Court of California held that mental health professionals have a duty to protect individuals who are being threatened with bodily harm by a patient. The original 1974 decision mandated warning the threatened individual, but a 1976 rehearing of the case by the California Supreme Court called for a “duty to protect” the intended victim. The professional may discharge the duty in several ways, including notifying the police, warning the intended victim, and/or taking other reasonable steps to protect the threatened individual. Poddar killed Tarasoff after telling his psychologist about plans to do so.

A

Report it to the proper authorities. Ahead of time, check local laws regarding reporting of abuse or neglect and include this information in your Declaration.

What is HIPAA?

A

The Health Insurance Portability and Accountability Act of 1996. It protects health insurance coverage for workers and their families when they change or lose their jobs and requires the establishment of national standards for electronic healthcare transactions and national identifiers for providers, health insurance plans, and employers.
