What is the two prong veracity test (Aguilar-Spinelli)
Veracity — meaning the person is generally worthy of belief; and
Basis of Knowledge — meaning the information provided is most likely accurate.
What are the There are 4 types of sources?
identified citizen, (These individuals, including police officers, are willing to have their name associated with the information they provide.)
identifiable citizen, (Sometimes officers do not learn or reveal a source’s name, but provide enough information to allow that person to be identified.) (spontaneous street report)
confidential, and
anonymous.
What are the Gun Possession plus factors? (13 factors)
- Suspect appears under 21 (tip that they are probably underage works)
- Gun history (past gun arrests, ineligible to carry)
- Firing gun
- Pointing gun
- Selling a gun
- Loading gun
- Brandishing or provocatively carrying (open carry is legal but can still detain on provocative display)
- Concealing / attempting to conceal (holding wasit band, blading, shielding)
- No hoslter (holding waist band)
- Possession during crime
- Weapon connected with crime (sawed off shotgun, tapped handle, large capacity l)
- Impaired
- Public safety risk (out of control or unconscious, screaming obscenities)
What is the best way to learn of a suspects gun license status?
Ask him, you can detain and frisk with reasonable suspicion, arrest required PC he is unlicensed
