Private agreements usually imposed by the owner when property is sold that limits the way the real estate ownership may be used; frequently used by owner/developer to maintain specific standards in a subdivision. Covenants are appurtenant also called protective covenants
Restrictive covenants
Regarding restrictive covenants what should the broker be responsible of?
- informing the prospective buyer of covenants and telling them to read the latest version of the covenants before making an offer
- be careful to not make assumptions and tell the prospective buyer what you think is ok and not ok
A developer of most new subdivisions must have streets approved based on construction standards set by Nc department of transportation and must devalue the streets to be for public or private use
