What does the OPC stand for and why was it created
L’office de protection du consommateur was created in 1971 in order to protect consumers
What are the objectives of the OPC ?
Monitor the application of the consumer protection laws
Also has a mission of informing the consumers as a collectivity and individually, to teach them and receive their complaints.
What kind of rules does the consumer protection act:
General rules that apply to merchants providing products and services to consumers and specific rules for certain types of products and services.
What right does the law give to consumers
The right to file a complaint with the OPC and to take legal action against a merchant to get compensations, to have a contract cancelled, etc.
What do merchants risk by not respecting the law ?
To be fined
What does the law aims to do in terms of advertisement ?
To stop certain advertisement practices which encourages a false representation to push consumers to buy.
What is forbidden by the law (advertisement) ?
- Advertising a price lower than a real price
- not mentioning an important fact in an advertisement or any other way of representing the product
- advertise goods or services for which a merchant has an insufficient quantity to meet the public demand unless it is mentioned in the advertisement and that the quantity is indicated

- A business cannot present data or an analysis falsely presented as scientific
- for a business to make false representation concerning the existence, extend and length of a warranty
- Omit to disclose, in an advertisement, the amount of the instalments to be paid for the purchase or long-term lease of goods or for a service without also disclosing, and laying greater emphasis on, the total price of the goods or service or, in the case of a long-term lease, the retail value of the goods.
What does the law say on advertisement for kids ?
No person may make use of commercial advertising directed at a person under thirteen years of age.
What does the law say about purchase
Purchasing a good is a contract and the seller is under no obligation to take back, exchange, give a store credit or give back his money to a consumer ( unless the item is defective)
What does the law say about deposit
Giving a deposit is considered a purchase. The seller can refuse to give back the deposit and he can force the consumer to fully purchase the item.
What precautions should you take when purchasing an object ?
- Plan a budget and do not abuse credit
- examine the marchandise before buying
- ask about the return policy
- if it’s a gift make sure it is written on the bill
- give the smallest deposit possible and make sure that the seller writes that the deposit is refundable on the bill
- keep the bill, the instructions, document pertaining the care of the product and any warranty document

Legal warranties (comes with every sold good and service)

Extended warranties
What does the legal warranty say?
That the business and market of the product have obligations toward the good.
Is the legal warranty charged ?
No
What does the legal warranty allows you to require ?
That the product has no hidden defects
That it can serve the use it is normally made for
It has a reasonable life span based on the price, the contract and the usage of the good
What is the basic warranty
(Conventional warranty)
Warranty that the seller or marker can offer. It adds to the legal warranty (doesn’t warranty) and is included in the purchasing contract and the purchasing price.
Is the basic warranty obligated to be written ?
No, it can be written or not.
How does the basic warranty apply to rents and buys
Any basic guaranty given to the buyer should also be given to someone who rents the good for minimum four months.
What is the extended warranty
A contract by which the seller agrees to take care of repairs and replacement of a good if it doesn’t work well
What should the seller do when selling an extended warranty
- inform the buyer of the legal warranty, it must be written on paper
- inform the buyer about the existence and length of the basic warranty
What about appliances repairs ?
According to OPC it is garantied and you have recourse against the personne who did it if the work is poorly done or charged at a higher price than expected.
When should the appliance repairman give a written evaluation and is it charged ?
An evaluation needs to be given when the repairs exceed 50$.
It should be free unless specified beforehand.
What should be included on an evaluation ?
Your name and that of the repair person
A description of the appliance to be repaired
Details about the repairs and it’s cot
The evaluation date and period for which it is valid
