Common Authority

A

mutual use of the property by persons generally having joint access or control for the most purposes, so that it is rsbl to recognize that any of the co-inhabitants has the right to permit the inspection in his own right and that the others have ASSUMED THE RISK that one of their number might permit the common area to be searched

mistake/apparent authority

A

warrantless search of premises is reasonable if the police reasonably but mistakenly believe that someone with common authority over the apartmetnt consent to the search of it

if it is unreasonable to believe a person has authoity, then warrantless entry is unlawful unless authoirty actually exists

this is lawful, fernandez v. california: when the co-resident is removed for objectively reasonable purposes, the remaining resident may validly consent to a search
