A

Everyone who conspires with any person to commit any offence, or to do or omit, in any part of the world, anything of which the doing or omission in NZ would be an offence, is liable to imprisonment

A

For a conspiracy there must be both an intention as well as agreement to do an unlawful act or a lawful act by unlawful means.

Yes but they are still guilty of conspiracy. If they withdraw before the actual agreement is made then they are not guilty.
