Elements of the Jennings Test

A

Precedent - expected practice, predictability, stability

Belief they ought to be followed - (cannot be determined by a single rule of thumb (AG V Jonothan Cape [1976]))

For a good constitutional reason - for conduct to be constitutional it should align with convention

“Jennings was not the only test”

How do we distinguish between conventions and laws?

A

Conventions
- Not legally enforceable
- A product of practice and tradition
- Inform and guide behaviour but do no mandate a particular approach

Laws
- are enforceable before the courts
- determines appropriate practice by setting standards and enforcing/regulating compliance with them
