A

  • It is not practicable to get a warrant
  • CADD (evidence related to suspected offence)
  • An offence is, is about to or has been committed

What powers does section 21 in SASA give you?

A

To search any person found in a place or vehicle when conducting a search under section 20.

You may

  • detain for duration of the search
  • search anything they are wearing in in their possession
  • size anything on them if it is the subject of that search or kawfully sized.

Additional powers under section 20

A
  • Require vehicle yo remain stopped for the duration of the search
  • secure the place or vehicle for the duration of the search
  • detain persons to allow the search to be carried out
  • detain persons who arrive or try to enter to determine a connection to the object of the search OR RGTS they have dangerous items on them that threatens safety and you believe immediate action is required
  • search anyone in or entering the place or vehicle and there is RGTB that evidentiary material is on that person
  • exclude a person who may hinder the search
  • use reasonable force for detention under 118
  • use reasonable force to enter and carry out search and sieze
  • seize anything subject of the search or lawfully siezed
