What is the crimes act s202A
Possession of offensive weapon or disabling substance.
CA191 S202A (1) Definition of offensive weapon
Means any article made or altered for use for causing bodily injury, or intended by the person having it with him or her for such use.
CA1961 202A (4)(b) offensive weapon means
Any artical capable of being used for causing bodily injury.
CA1961 s202A (3) disabling substance means
Any anaesthetising or other substance produced for use for disabling persons, or intended by any person having it with him or her for such use.
(3) Everyone is liable to imprisonment for a term not exceeding 3 years who…
a) without lawfully authority or reasonable excuse, has with him/her in any public place any knife, offensive weapon, disabling substance
b) has in his her possession in any place any knife, offensive weapon, disabling substance that prima facie shows an intention to use it to commit an offense involving bodily injury or the treat or fear of violence
(5) What is a defence
It is a defence to charge if under (4) (b) if the person charged proves that he or she dis not intend to use the offensive weapon… to commit an offense involving bodily injury or threat of fear or violence.
