What points should be considered before conducting a Personal Search?
Authority: There must be clear and reasonable grounds for search and permission from the proper manager must be obtained.
Appeal: The person has a statutory right of appeal or to ask that the decision tosearch be rescinded under RA 96(3). They must be informed of the right to appeal and the appeals process must have run its course prior to a search being commenced.
Location: A sterile private search room must be utilized. The room must be clean for both the person and their clothing.
Security: The person must be escorted to and from the search room by a minimum of 2 officers. Both officers should remain with the subject at all times. One of the officers should be positioned between the person being searched and the door of the search room. There must be no unsecured objects in the room.
Personnel: 2 Male only officers for a male passenger, 2 female officers for female passengers. One officer conducts the search while the second officer is the witness and records significant data arising from the search procedure in the search room.
