What are the aims of custodial sentencing
1) deterrence - put of society from committing crimes
2)incapacitation - protect the public from criminal
3) retribution- they get sentence they deserve
4) rehabilitation - opportunties for training and treatment

emphasis of retribution and punishment has led to some highest recidivism rates in Europe 57% will reoffend within a year
Norway on other hand has has lowest rates has much greater rate of rehabilitation
Weaknesses of custodial sentencing
1) high rates of recidivism for large number of prison population suggest its not effective - punishment most effective when occurs immediately - offender may see sentence as a punishment for being caught not for actual crime
2) prisoners may associate with more people with pro crime attitudes and may learn particular techniques for commiting crime in prison . Placing low risk offenders with high risk offendersbmakes it more likely they will re offend
strengths of custodial sentencing
Many prisoners can access education and training in prison increasing possibility they will find employment
Treatment programmes like CBT, anger managment may give offenders insight into their behaviour
Many prisons lack these resources to provide these programmes
