Victim is
a person against whom the offence was commited/member of the family/child.
Police must refer to the Victim Support when
- The incident is serious
- The victim is significantly affected
- The victim is likely to be involved with the justice system.
Section 7, Victim’s right Act 2002
Victims should be treated with courtesy, compassion, respect for their personal dignity and privacy.
Section 8, Victim’s right Act 2002
Victims should have access to welfare, health, councelling.
Section 11, Victim’s right Act 2002
Officers should inform the victims ASAP about available services/programmes.
Section 12, Victim’s right Act 2002
The prosecution must advise the victim about:
- progress of the investigation
- charges filed or action taken
- date and place pf proceedings
- role of the victim as a witness
- outcome of proceedings
Section 51, Victim’s right Act 2002
Property held as evidence should be returned as soon as possible.
Two stages of emotional reaction
- impact stage
- recoil stage
Impact stage
Happens immediately after offence. Includes:
- Numbness
- Disorientation
- Immobilisation
- Feeling of unreality
- Childlike Dependence
Recoil stage occurs
victim begin to adapt.
