What are the possible disciplinary proceedings?

A

Regulatory compliance order - Formal written agreement between RICS and member/firms

Fixed Penalty - Administrative fine issued by the RICS for failure to provide RICS information

Panel Hearing - For serious breaches - Panel of 8 members, 8 lay members and chairperson

What is a regulatory compliance order?

A

A Regulatory Compliance Order is an agreement between RICS and a Regulated Member that they are liable for disciplinary action

Can include:

  • Fine up to £2,000 per breach
  • Pay RICS costs
  • The number of consent orders are published on the RICS website each quarter

What goes directly to the RICS disciplinary board?

A
  • Upon receipt of a complaint about a member or firm, the head of regulation will make further enquiries as deemed appropriate.
  • A fixed penalty may be issued or the individual/firm will be informed that they may be liable for disciplinary proceedings.

• Fixed penalties – fines applied to specific situations e.g. Failure to provide information to the RICS or failure to pay registration fees.
o Paid within 1-28 days =£150 members, £300 firms
o 29-56 days = £250 members, £500 firms
o Over 57 days = disciplinary panel

Disciplinary panel deal with:
• Public hearings conducted by a panel
• For serious breaches of conduct
• Determined by a vote, requiring a simple majority
• Sanctions include caution, unlimited fine and expulsion from RICS

What are the CPD sanctions?

A

Failure first time results in a caution

Failure a 2nd time will result in caution and a fine (details also being posted on RICS website)

Failure a 3rd time will normally result in referral to a Disciplinary Panel

Explain the disciplinary panel

A

Panels for hearings are selected from the Conduct and Appeal Committee

Consists of 19 lay members and 8 RICS professionals

Comprises of a Chair & 2 other panellists (1 must be lay)

Role is to hear disciplinary cases involving members and to make findings of facts, decide whether a member is liable for disciplinary action, decide on level of sanction.

Sanctions include:

  • Cautions
  • Imposing fines
  • Imposing conditions
  • Expelling professionals
  • Deregistering firms
