What are the two types of sexual harassment?
Quid pro quo sexual harassment - unwelcome sexual conduct used as basis for employment decisions affecting such individual
Hostile environment - unwelcome sexual conduct interfering with an individuals job performance or creating a bad work environment
What is a third party wrongful act?
Any EPLI related claim made by non-employees (usually some sort of harassment) against the insured (including their employees)
What are the main exclusions in an EPLI policy?
Criminal, Fraudulent, or Malicious Acts
BI/PD
Contractual Liability
Work Comp
Violation of Certain laws (OSHA, ERISA, NLRA)
Wage and Hour claims (not paying employees what they are owed)
ADA compliance
Breach of written employment contract
