Pressure groups

A

Protect rights:
* raise awareness
* apply pressure
* e.g. Joanaa Lumley & the Gurkha’s 2009 (when law got changed ] gurkhas not given same recognition/ treatment for fighting in British military > Gurka justice campaign

Not protecting rights:
* have no power > cannot force gov. to change legislation
* e.g. penal reform for prisoners to be able to vote ] prisoners still cannot vote

Supreme Court

A

Protect rights:
* declaration of incompatibilty given by the HRA (gov. passes leg. that conflicts with ECHR) > does work e.g. Rwanda - trying to stop the flights

Not protecting rights:
* declaration of incompatibility has no legal power > just a suggestion > Rwanda] just changed the wording

Gov/ Parl - HRA

A

Protect rights:
* passing legislation
* e.g. same-sex marriage act, minimum wage
* HRA 1998:
~incorprorated the ECHR into UK law
~clear statement of UK citizens’ civil liberties, enforceable in the courts
~established the “positive rights” UK citizens are entitled to e.g. right to fair trial

Not protecting rights:
* can work the other way > legislation that counteracts human rights
* e.g. bill that limited people’s right to protest & police’s right tpo break up protests
