What are the established principles of Evidence?

A

-any person making a positive assertion of fact must prove his allegations by producing evidence that will satisfy the court

  • in establishing such facts, the evidence must be relevant and admissible
    a) evidence is relevant if it goes to proving or disproving a fact in issue
    b) evidence is admissible if it is relevant and is allowed by the judge

-all accused persons must be dealt with fairly at all stages of the proceedings
