Civil Marriage Act (2005)
a federal statue legalizing same-sex marriage across Canada
Divorce
- a petition under federal jurisdiction for a dissolution of a marriage
- 1960/70s rise in divorce rates due to a number of factors
Divorce Act of 1968:
- the first federal statue
- grounds for petition primarily based on the notion of fault (Sec. 3 + 4)
- separation of 3-5 years required (no-fault), (sec.4)
Knoll v. Knoll (1970)
- Determination of mental cruelty
- Wife faced mental cruelty for years and field for divorce on the basis of this cruelty
- At first, she was denied as there was no “evidence” to show her torture
- Went to Ontario Court of Appeal and divorce was granted
Divorce Act of 1985:
fault still required
