What is a legal right?
Legal rights refer to all those rights found within existing legal codes. A legal right is a right that enjoys the recognition and protection of the law.
What is police power?
It is the power to prescribe regulations to promote the health, morals, education, good order, safety, or general welfare of the people.
What is eminent domain?
The power of eminent domain allows governments to take property if it is needed for public use.
What are the only limitations on the power of the legislature about eminent domain?
The limitation is found in Section 9, Article III of the 1987 Constitution, which states: ‘Private property shall not be taken for public use without just compensation.’ The two essential limitations are: 1. The purpose of taking must be for public use. 2. Just compensation must be given to the owner of the private property.
