What is justiciability?

A

you must have a justiciable case before you can proceed to the grounds of judicial review, courts need to consider if the cases raises legal issues that they need to resolve

what is the GCHQ case?

A

prerogative powers may be subject to judicial review, however, when national security at stake judicial review not available or at least subject constraints. To summarise, courts could not interfere and resolve the matter.
