  1. Professionalism - Act in an honest, fair, transparent, and professional manner.
  2. Skills & Due Diligence - Carry out work with due skill, care, and diligence. Ensure all staff employed have the necessary skills to carry out their tasks.
    3.** Terms of Business** - Ensure that clients are provided with terms of business that are fair and clear, with the CHP.

A

What does the Consumer Protection Regulation seek to do?

A

Prohibit unfair business-to-consumer practices on all lettings and sales, as well as online agency. Unfair practices could include giving false or misleading information, hiding or failing to provide information, omission (leaving something out), and exerting undue pressure on consumers or failing to show professional diligence.

To combat this all agency processes/systems should be demonstrated with a due diligence audit trail.

Who are the Consumer Protection Regulations and the Business Protection Regulations policed by and what are the penalties for a breach?

A

The penalties are an unlimited fine and/or a prohibition order. Compensation may also need to be paid to the complainant up to £25,000.
This is policed by the Trading Standards Office in the local authority.

  • Agents must declare everything known about a property - good and bad.
  • Agents have a duty of care to clients and all interested parties
  • Regulations apply to all sales and lettings
  • Any information from the client should be verified, or if not available states as advised by the vendor (not good enough to say relied upon if extra steps should have been taken).
  • Disclaimers do not act as evidence if this offence is committed.

What does the Business Protection from Misleading Marketing Regulated (2008) seek to do?
Prohibits misleading business-to-business advertising and imposes restrictions on how businesses compare their products to products from other companies.

What is meant by Caveat Emptor?
'Let the buyer beware'. It is the starting point for discussing who has the responsibility for the disclosure of information. Common law principle means the buyer should satisfy itself on all matters relating to the property.

What does the Consumer Rights Act 2015 relate to?
it consolidates the law relating to unfair terms and contracts between businesses and consumers. It outlines that lettings agents must clearly display a summary of their charges in the office and on their website for the letting and management of property. Information must be provided based on calculation of charges and who is responsible for payment.

It is policed by the local authority and the penalty is a fine up to £5,000 for each breach.

The Act relates to misrepresentation or a false statement of fact made by a party during pre-contractual enquiries, which has the effect of inducing the party to purchase, where the vendor and/or agent can be sued for damages and/or the contract rescinded. It provides cover for civil offences (not criminal).
