What is compulsory acquisition?
When the owner won’t agree on a price or sell, the government will use eminent domain to take the property.
What is fair compensation?
Compensation that is deemed just and reasonable for property taken under eminent domain.
What does public use refer to?
The requirement that property taken under eminent domain must be used for the benefit of the public.
What are zoning laws?
Regulations that designate different areas for different uses (residential, commercial, industrial).
What are building codes?
Regulations/rules regarding material use or safety in the structure.
What do health regulations ensure?
They ensure that food is safe and clean.
What is the purpose of environmental protection rules?
To prevent pollution, conserve natural resources, and preserve the beauty of landscapes.
What are licensing regulations?
Regulations imposed on professions regarding licensing, training, and schooling.
What is the role of emergency powers?
To maintain order, ensure public safety, and respond to crises.
What is a special exception?
An allowance for how property may be used without conforming to zoning regulations.
What is a building code variance?
A request to comply with building codes to do something that does not conform. Which then goes under review, and a decision. It may come back with certain conditions. It MUST have documentation.
What is urban renewal?
The process of reconstructing degraded downtown areas over time.
What is a public-private partnership?
A collaborative agreement between government and private sector for development projects.
What is mixed-use development?
A type of development that incorporates residential, commercial, and other uses in a single area.
What is police power?
The government’s power to regulate behavior and enforce order within their territory for the benefit of the people.
What does licensing entail?
Legislative action that grants the government the power to enforce or impose regulations in certain industries.
What is a non-conforming use?
A property that is used in a way that was previously zoned until it is transferred to a new owner, at which point it must conform to new zoning regulations.
What is a conditional use permit?
A one-time exception for the use of a property for a purpose it is not zoned for, granted temporarily.
What does zoning code A represent?
Agriculture (Barns, farms, animals…).
What does zoning code R represent?
Residential (single/multi-family housing).
What does zoning code C represent?
Commercial (business operational use).
What is zoning?
Police power of determining how property may be used to improve overall value and enjoyment.
What is a zoning district?
An area zoned for a specific use or purpose, a tool of urban planning that controls land uses within a city
What does zoning code M represent?
Industrial / manufacturing (production - transportation)
