People v. Sanchez
Sanchez convicted of several firearms and gang related charges. Sanchez appealed stating trial court erred in admitting case-specific statements related by the prosecution expert concerning his gang membership. Specifically, he argued that admission of this evidence violated the federal confrontation clause because the declarants were unavailable to be cross-examined. Supreme court reversed jury findings on gang-enhancements because inadmissable hearsay. Expert CANNOT SPEAK ON CASE-SPECIFIC FACTS
People v. Prunty
After jury trial, defendant charged with attempt murder and assault with firearm. Prosecution stated these offenses committed for benefit of criminal street gang and subject to enhancement. Ultimately, Supreme Court reversed judgement on sentence as no evidence that “organizational or associational connection uniting group members”. Existence of gang subsets. Questions 186.22(f).

Alleged gang member is seen with 3 other gang members around 2 stolen cars. This person and another gang member from group get into one of the stolen cars. Our subject is driving the stolen car and other has a loaded gun in his pocket.

186.22(f)
As used in this chapter, “criminal street gang” means any ongoing organization, association, or group of three or more persons, whether formal or informal, having as one of its primary activities the commission of one or more of the criminal acts enumerated in paragraphs (1) to (25), inclusive, or (31) to (33), inclusive, of subdivision (e), having a common name or common identifying sign or symbol, and whose members individually or collectively engage in, or have engaged in, a pattern of criminal gang activity.

As used in this chapter, “pattern of criminal gang activity” means the commission of, attempted commission of, conspiracy to commit, or solicitation of, sustained juvenile petition for, or conviction of two or more of the following offenses, provided at least one of these offenses occurred after the effective date of this chapter and the last of those offenses occurred within three years after a prior offense, and the offenses were committed on separate occasions, or by two or more persons: (burg, murder, arson, adw, dope sales, firearms viol etc)

In Re: Frank S. Case Law
An illustrative case is In re Frank S. (2006) 141 Cal.App.4th 1192, where the
defendant was arrested for being in possession of a concealed knife. He told the officer that
he had been attacked two days earlier and needed the knife for protection against “the Southerners” because they believed he supported northern street gangs, among whom he had
several friends. At trial, an expert witness testified that it was her belief that the defendant
possessed the knife to protect himself. She said that gang members use knives for protection
from rival gang members and to assault rival gang members. She stated further that
possession of the knife benefitted defendant’s gang by providing them with protection
should they be assaulted. (Id., at pp. 1195-1196.)
The Fifth District Court of Appeal held that this testimony was insufficient to support
the gang enhancement. The defendant’s criminal history and gang affiliations cannot solely
support a finding that a crime is gang related. The Court stated that “[w]hile evidence
established the minor has an affiliation with the Nortenos, membership alone does not prove
a specific intent to use the knife to promote, further, or assist in criminal conduct by gang members
