What guidance do RICS provide on H & S?
RICS Guidance Note ‘Surveying Safely – Health and Safety Principles for Property Professionals’ (2nd Edition) 2019
What is meant by the safe person concept?
The individual assumes behaviour responsibility for self, colleagues, and others while at work. Ensure people have the tools to undertake their jobs safely.
What might you consider when inspecting?
- Tell someone where you are going and when you leave
- If and what PPE is required
- Sign in and out – receive site induction
- Consider whether safe to inspect alone and observe lone-working arrangements
- Check dated tag if going on scaffolding
- Non-slip shoes if climbing ladder

Explain your understanding of the term HSE?
- HSE stands for the Health & Safety Executive .
- The HSE is the UK national authority for managing work related health, safety and illness issues.
- They act in the public interest to reduce work related injuries and incidents.
- Their aim is to protect people’s health and safety by ensuring that risks are properly managed.
- They also support businesses to change and adapt in order to remain compliant with occupational health and safety legislation.
What is the Health and Safety at Work Act 1974?
- Primary UK legislation governing H & S.
- Sets out duties of employers, self employed persons, persons in control of premises, employees, manufacturers and suppliers.
- They must safe guard H & S of employees and public who may be affected by their work.
- Enforced by the HSE.
- Penalties can include fines and imprisonment.
What are the Management of Health and Safety at Work Regulations 1999?
- Requires employers to carry out risk assessments, make arrangements to implement necessary measures, appoint competent people and arrange for appropriate information and training.
What are the CDM 2015 Regulations?
- Construction Design and Management Regulations.
- The main set of regulations for managing the health, safety and welfare of construction projects.
What is a risk assessment?
- The process of identifying what hazards currently exist or may appear in the workplace.
- They are a legal requirement for employers of five or more.
How do the HSE recommend they are approached?
- Identify hazards
- Identify people at risk
- Evaluate risk – likelihood and severity. Existing controls should be identified and evaluated
- Record findings on suitable form
- Review risk assessment regularly
What are the ‘Six Point’ of H & S regs?
- Introduced January 1983 – clarify how employers must comply with Health and Safety at Work Act 1974.

What does the Beaufort Scale measure?
- This is used to measure windspeed which is important when working on site.
When are visitors most likely to have an accident on a construction site?
- When they first start on a new site.
What should you do if you find an injured person on site?
- Assess the situation first without putting yourself in immediate danger.
- Call the emergency services if serious.
- Raise the alarm and call for help.
What is required under The Fire Safety Act 2021?
- All responsible persons are required to assess, manage, and reduce fire risk in multi-occupied domestic buildings posed by:
o Structure
o External walls
o Common areas - Allows Fire Service to take enforcement action
- Consider resident fire safety plans, evacuation plans, regular inspections of lifts to be reported to Fire Service
What is the significance of the Grenfell and Hackitt Review?
- UK Government produced External Wall Systems 1 Form to enable valuation of tall residential buildings (flats, student accommodation, HMOs – not hotels).
- Form requires ‘qualified professional’ to confirm external wall system has been assessed for safety:
The height of the building
Type of cladding and how much
Presence of balconies and combustible material - The forms are valid for 5 years.
- Not every building requires one.
- RICS released guidance to assist on whether form required.
- Valuer’s must follow instructions from client and have a rationale to request form completion.
- Large delay in form as few ‘qualified professionals’ to undertake assessment.
What is the Building Safety Bill 2021?
- Building Safety Act received Royal Assent on 28/04/22. Amends Architects Act 1997 and requires c.12-48 months before majority comes into force. Currently developing secondary legislation.
- Designed to enhance building safety. Expected implementation of Hackitt Review (Grenfell). Oversee whole built environment with local enforcement and national regulation to:
- Ensure accountability for those responsible for safety in high-rise buildings
- Provide resident’s ability to contribute towards safety
- Enforcement for non-compliance
- National framework to ensure suitability of building products
- New build developers must belong to New Homes Ombudsman
- Imposes new separate duties on CDM duty-holders
- Changes to Defective Premises Act and s.38 Buildings Act limitation periods (namely Limitation Act 1980 extended to 15 years for claims to be brought)
- Can now introduce claims up to 30 years after completion of the dwelling.
What is Asbestos?
- An Insulating material. If disturbed, can produce very small toxic fibres which can lodge in lungs and cause diseases.
- Health and Safety Executive estimates affects 4 million properties in UK.
What are the common types?
- Brown (amosite)
- Blue (crocidolite)
- White (chrysotile)
Plus 3 rare types not often mined: tremolite, anthophyllite, actinolite.
What is the most dangerous and where is it often found in a building?
- Blue – roofing and tiles
- Fire protection, insulation boards, plumbing insulation…
What does The Control of Asbestos Regulations 2012 apply to?
- Applies to non-domestic and communal areas of domestic.
- Non-compliance is a criminal offence.
- Regulation 4 - statutory duty to manage existing asbestos in commercial property. Two obligations:
1. Duty holder Regulation 4 – owner if vacant, tenant if holding repairing lease. Must manage risk – risk assessment, written plan and reviews recorded.
2. Employer Regulation 5
