What health & safety legislation are you aware of?
I am aware of the Health and Safety at Work Act 1974, which states employers are responsible for the safety of their employees at work. This is done by preventing potential dangers in the workplace. It places a duty on the employer regarding the health, safety, and welfare of all persons at work.
How do you ensure that you comply with this legislation?
As an employee the legislation states that I must also be responsible for my own health and safety and of others that may be affected by my actions at work. So bringing the right PPE when I go out on inspections.
What are the penalties under current health & safety legislation?
Penalities include fines, imprisonment, prohibition notices, or disqualification
Is it a criminal offence to breach the H&S at Work Act 1974?
Yes it is a criminal offence to breach this legislation. Local authorities or the Health and Safety Executive can prosecute individuals or companies for breaches of the Act.
Tell me about your employer’s health & safety policy?
JLL policies on health and safety include applying risk management principles to identify hazards and ways to elimate, minimise, or control the hazards. JLL also provide regular training on H&S relevant to their role.
What are your health & safety duties as an individual surveyor?
As an individual surveyor my duties include ensuring my own health and safety and that of others who may be affected by my actions. When on site and inspecting alone adhere to Surveying Safely 2018 lone working policies as well as my companies health and safety polcies. Including taking a fully charged phone, making others aware where I’m going and when I arrive and leave site.
What guidance does the RICS produce about H&S?
The RICS produced Surveying Safely 2nd Edition 2018 which came into effect February 2019
Tell me something you understand from reading Surveying Safely.
I understand the concept of a ‘Safe person’ which is an individual that assumes individual behavioural responsibility for their own, their colleagues, and others’ health and safety while at work. I also understand that regulated firms must provide safe work equipment and work environment.

What are the key changes?
Key change was the introduction of the ‘safe person’ concept.
What is the safe person concept?
This is when each individual assumes behavioural responsibility for their own, their colleagues, and others’ health and safety while at work.
What must Regulated Firms provide?
Regulated firms must ensure they provide a safe working environment, safe work equipment, safe systems of work, and competent staff.
What happened in the case of Suzy Lamplugh?
She was an estate agent who dissapeared during the course of her work in 1986.
Why is the case of Suzy L important for surveyors?
It emphasised the dangers of lone working and meeting strangers which is common in the surveying profession. It also highlights the importance of client verification and knowing who you will be meeting on site.
What is Personal Protective Equipment (PPE)?
PPE is protective clothing that is used to minise exposure to hazards. It includes clothing such as steel toe capped shoes, high vis jackets, and hard hats.
What is a risk assessment?
It is the process of identifying hazards, analysing and evaluating the risk associated with that hazard and determing appropriate ways to elimate or control the hazard. It is also a legal requirement that employers employing more than 5 people to carry out document health and safety risk assessments.
What is a risk?
A risk is the likelihood that a hazard will cause harm, injury or adverse health effects. An example is the likelihood of falling off a ladder.

A hazard is anything that has the potential to cause harm. An example is a ladder.
How would you undertake a risk assessment before attending site?
Before attending site you can gather information like asking the client or site owner of any known hazards or ongoing works at the site. You can also request if there is asbestos present or contaminated land.
What is asbestos?
Asbestos is an insulating material that is can cause serious health issues and fatal diseas. Left undamaged and undisturbed it poses no health risks but if disturbed it can cause small micro fibres to be released and when inhaled can cause damage to your lungs.
What legislation are you aware of in relation to asbestos?
The Control of Asbestos Regulations 2021.
What do you understand by the Control of Asbestos Regulations 2012?
It is a legislation that deals with the management and handling of asbestos in buildings and workplaces. Regulation came into force in 2012.
Who is the duty holder?
The duty holder is the client, building owner, landlord or anyone with a clear responsibility for the building’s maintenance or repair.
How does asbestos cause lung damage?
When disturbed or damaged it can release small micro fibres that when inhaled cause serious health issues and or death.
