S.1 criminal procedure act 1991- must be evidence from two doctors and one must be an expert in mental health. This has three stages (mcnaughten)

The d must be suffering from a defect of reason. This must be more than temporary absentmindedness or confusion (Clarke)

A
The defect of reason must have been caused by a disease of the mind. This must be an internal factor

D must not understand the nature and quality of their act. They didn’t know what they were doing was wrong or what the consequences would be (windle)
