What is insanity defined as and under?
Where D suffers from a defect of reason caused by a disease of the mind that causes them to not understand the N&Q of their acts or what they were doing was wrong (Mcnaughten rules)
What is a defect of reason?
Total deprivation of power to control the mind (Clarke)
What is a disease of the mind?
A RMC by the WHO (burgess-sleepwalking)
What does D have to not understand?
N&Q of act or that what they were doing was legally wrong (windle)
What is automatism?
An action done by the muscles without any control by the mind done by a person who is not conscious of what they are doing (bratty)
What does D need to lose?
Complete destruction of voluntary control (Baxter)
How does this need to be caused?
By an external factor such as diabetes
How is automatism self induced?
Aware actions will bring state of automatism so intoxication rules will apply (lipman)
