Copyright
Gives rights to the creators of certain material to allow them to control how it is used. Lasts for 70yrs (50 for audio) from author’s death.
Design Right
Protects the aesthetic of a 3D product. Lasts 10yrs and can be extended by 5yrs only from day of creation. Can be purchased, sold or licensed.
Intellectual Property
Gives legal recognition to the ownership of new ideas or brand names.
Patent
Monopoly right granted by the Crown to the exclusive use of an invention. Can last for 20yrs, if fees payed per anum. Nothing to do with aesthetics! Only function.
What criteria must something meet to be eligable for a patent?
Must meet something from:
- New and previously undisclosed.
- Distinguished by an inventive step.
Must meet:
- Capable of industrial application.
Patent Office
Responsible for granting intellectual property in the UK only.
Registered Design
Monopoly right for the outward appearance of an article. Lasts 5 years but can be extended up to 25yrs max. Can be bought, sold, hired or licensed. Must not have been done before.
