What is Intellectual Property?
Intangible property from ideas, e.g. inventions, symbols, designs.
What is the purpose of a Trademark?
Distinguish goods/services, protect brand and goodwill.
What are the requirements for a Trademark?
Must be distinctive, graphic, can include names, shapes, jingles.
How long does Trademark registration last?
Lasts 10 years, renewable, remedies: injunction, damages, etc.
What is Passing Off?
Protects unregistered marks from being copied.
What is the definition of a Patent?
Protects inventions/processes with technical solutions.
What are the criteria for a Patent?
Must be new, inventive, industrially applicable.
What rights does a Patent grant?
Gives inventor monopoly; can license/sell; lasts 20 years.
What is Patent Infringement?
Making or using patented item without permission.
What does Copyright protect?
Protects original literary/artistic/dramatic works.
What is the law regarding Copyright registration?
No registration required; lasts up to 70 years.
Who owns Copyright in employment?
Employer owns work created during job unless agreed otherwise.
What remedies are available for Copyright infringement?
Injunction, damages, handover of copies.
