Explain Intentional Torts
To win a case for intentional torts, a plaintiff must prove:
- Wrongful conduct
- Causation of harm
- Actual harm
Common Intentional Torts:
Battery: Intentional, unwanted physical contact
Defense –> Self-defense
Assault: Causing fear of imminent harm
Defense –> Overreaction or provocation
Conversion: Taking or using someone’s property
Defense –> Consent
Trespass: Entering someone’s land without permission
Defense –> Honest belief or necessity
Deceit: Lying about past or present facts to mislead
Defense –> Truth
False Imprisonment: Restricting someone’s movement without legal reason
Defense –> Lawful authority
Malicious Prosecution: Wrongfully initiating criminal charges without just cause
Defamation: Damaging someone’s reputation through false statements
Libel = written
Slander = spoken
Defense: Truth, fair comment, or privilege
