What are intestacy laws?
State statutes governing the distribution of property not passing under a will
Also known as statutes of descent and distribution.
What is a testacy proceeding?
A proceeding to establish a will or determine intestacy
Define total intestacy.
Occurs when the decedent never made a will, made an invalid will, revoked a valid will, or had a valid will successfully challenged.
Define partial intestacy.
Occurs when a will does not cover all of the testator’s property.
In intestate succession, how does a surviving spouse’s share depend on other relatives?
The share varies based on the presence of descendants or parents of the decedent.
What does the general rule state about a surviving spouse’s inheritance?
A surviving spouse will always take some portion of the decedent’s estate.
What does a surviving spouse receive if there are no surviving descendants or parents?
The entire estate.
