What is literal rule?
Used when the words of the statute are clear in their natural meaning
What is interpretation of statutes?
Laws exists, created or enacted by Legislature
What is interpretation of statutes used for?
To aid judges in interpreting a particular statute.
What relevant authorities is stated in the Literal Rule?
Civil Law Act 1956 Section 3 (1)
What does Civil Law Act 1956 Section 3 (1) states?
may be made by any written law in force in Malaysia

What does literal rule do?
It explains what the law is rather than what the law means

West Malaysia applies the common law of England and the rules of Equity as administered in England on 7th April 1956
What does Civil Law Act 1956 Section 3 (1) (a) mean?
Malaysian courts would be bound to apply common law of England and the rules of equity
Advantages of Literal Rule?
Restricts the role of the judge from using their own opinions
Disadvantages of Literal Rule?
Creates loophole when judges apply the law only from the act

What is the Mischief Rule?
questions what the law was before to an Act and what flaws were remedied
What does Heydon’s Case [1584] ER 637 states?
A) What was the common law before the making of the Act

C) What remedy for that mischief in the law that the Parliament intend to provide
D) What was the true reason for parliament to adopt the remedy
Importance of Mischief Rule?
Aids in the avoidance of unjust outcomes
Encourages legal flexibility
Advantages of Mischief Rule?
Law Commission considers it to be significantly more satisfactory method of reading acts comparing Literal or Golden Rule
Frequently avoids ludicrous sentencing outcomes
Disadvantages of Mischief Rule?
Leads to uncertainty in the law

What is the Golden Rule?
Asks you to read the term as a whole in the context of law
If an absurdity is created by the literal rule…
then the court should attempt another interpretation to prevent absurd rules
What does the Golden Rule functions as?
As a bridge between literalism and purposiveness
Advantages of the Golden Rule
Allows judges to choose the most sensible meanings in situations where the word of an Act potentially have more than one meaning
Prevents unacceptable situations
