  • President nominates (most from federal court of Appeals)
  • Shortlisted & checked
  • Interviews by president
  • Presidents choice is announced
  • SJC vote on nominee
  • Senate then vote on simple majority

  • Detailed scrutiny by White House, FBI, SJC & media
  • Senate confirmation provides check on power of president
  • Attempts for pres to pick justices who share same political ides aren’t always successful (Bush appointed Souter in 1990, and later became liberal)

    -SJC can be politicised (questioning is focused on embarrassing nominee rather that judicial expertise)
