- President nominates (most from federal court of Appeals)
- Shortlisted & checked
- Interviews by president
- Presidents choice is announced
- SJC vote on nominee
- Senate then vote on simple majority

A
- Detailed scrutiny by White House, FBI, SJC & media
- Senate confirmation provides check on power of president
- Attempts for pres to pick justices who share same political ides aren’t always successful (Bush appointed Souter in 1990, and later became liberal)

- Presidents choose nominees with same political philosophy
-SJC can be politicised (questioning is focused on embarrassing nominee rather that judicial expertise)
