Burg 1st
A person is guilty of burglary in the first degree when, with the intent to commit a
crime, he or she knowingly enters or remains unlawfully in a building, and
(a) Is armed with explosives or a deadly weapon;
(b) Causes physical injury to any person who is not a participant in the crime; or
(c) Uses or threatens the use of a dangerous instrument against any person who is
not a participant in the crime.
(2) Burglary in the first degree is a Class B felony

A person is guilty of burglary in the second degree when, with the intent to commit
a crime, he or she knowingly enters or remains unlawfully in a dwelling.
Burglary in the second degree is a Class C felony
Burg 3rd
A person is guilty of burglary in the third degree when, with the intent to commit a
crime, he or she knowingly enters or remains unlawfully in a building.
Burglary in the third degree is a Class D felony
Criminal Trespass 1st
A person is guilty of criminal trespass in the first degree when he or she knowingly
enters or remains unlawfully in a dwelling.
Criminal trespass in the first degree is a Class A misdemeanor
Criminal Trespass 2nd
A person is guilty of criminal trespass in the second degree when he or she
knowingly enters or remains unlawfully in a building or upon premises as to which
notice against trespass is given by fencing or other enclosure.
Criminal trespass in the second degree is a Class B misdemeanor
Criminal Trespass 3rd
A person is guilty of criminal trespass in the third degree when he knowingly enters
or remains unlawfully in or upon premises.
Criminal trespass in the third degree is a violation
Rob 1st
A person is guilty of robbery in the first degree when, in the course of committing theft, he or she uses or threatens the immediate use of physical force upon another
person with intent to accomplish the theft and when he or she:
Causes physical injury to any person who is not a participant in the crime; or
Is armed with a deadly weapon; or
Uses or threatens to use dangerous instrument
Robbery in the first degree is a Class B felony
Rob 2nd
A person is guilty of robbery in the second degree when, in the course of committing theft, he or she uses or threatens the immediate use of physical force upon another person with intent to accomplish the theft.
(2) Robbery in the second degree is a Class C felony
Disorderly Conduct 1st
Causes disturbance near funeral home or cemetery
Disorderly conduct 2nd
A person is guilty of disorderly conduct in the second degree when in a public place
and with intent to cause public inconvenience, annoyance, or alarm, or wantonly creating a risk thereof, he:
(a) Engages in fighting or in violent, tumultuous, or threatening behavior;
(b) Makes unreasonable noise;
(c) Refuses to obey an official order to disperse issued to maintain public safety
in dangerous proximity to a fire, hazard, or other emergency; or
(d) Creates a hazardous or physically offensive condition by any act that serves no
legitimate purpose.
(2) Disorderly conduct in the second degree is a Class B misdemeanor.
Terroristic Threatening 1st
Threat of Weapon of mass destruction in School, Government, DV Shelter, Workplace, or gathering of 3 or more people
Terroristic Threatening 2nd
Threat of shoot in church, School, Government, DV Shelter, Workplace, or gathering of 3 or more people
Terroristic Threatening 3rd
He threatens to commit any crime likely to result in death or serious physical
injury to another person or likely to result in substantial property damage to
another person; or
(b) He intentionally makes false statements for the purpose of causing evacuation
of a building, place of assembly, or facility of public transportation
