What is the purpose of the Sex Offenders Registration Act 2004?
Section 1 The purpose of this act is -
(A) to require certain offenders who commit sexual offenders offences to keep police informed of their whereabouts and other personal details for a period of time -
(B) to prevent registrable offenders working in child related employment.
(C) to empower the IBAC to monitor compliance with parts 3 and 4 of this act;
(D) to provide the making of prohibition orders to prevent registrable offenders engaging in certain conduct.
What are the two sub points regarding making offenders report?
(i) to reduce the likelihood that they will re-offend; and
(ii) to facilitate the investigation and prosecution of any offences that they may commit.
What is a registrable offence?
Section 7 SORA
- Class 1 offence committed by an adult (found in schedule 1 - serious sex offences against a child - penetrative); or
- Class 2 offence committed by an adult (found in schedule 2 - sexual offence against a child); or
An offence that results in the making of a sex offender registration order (s. 11)
What is section 11 SORA?
(1) If a court finds a person guilty of an offence that is not a class 1 or class 2 offence (including an offence that is a class 3 or class 4 offence), it may order that the person comply with reporting obligations of this Act.
What is a serious sexual offender?
A serious sexual offender is a person who has at any time been sentenced for 2 or more offences listed in a schedule in the act - section 8(3).
What is a class 3 and class 4 offence?
Section 8 SORA states:
A class 3 offence is an offence listed in schedule 3 committed against an adult by a person who is a serious sexual offender. (Penetrative)
A class 4 offence is an offence listed in schedule 4 committed against an adult by a person who is a serious sexual offender. (Non-penetrative)
