Mental disorder definition
problem with thinking, emotions, or behavior that makes living hard
Automatism definition (insane)
caused by a mental disorder.
If proven then the person is found not criminally responsible and may be treated in a hospital.
Intoxication definition
a person’s body is affected by alcohol/drugs making it hard to act normally.
Self defence definition
when someone uses reasonable force to protect themselves or others from harm.
Battered woman syndrome definition
mental state from long term abuse where victim feels trapped and may act in self defence.
Defence of a dwelling definition
right to protect your home from intruders using reasonable force.
Necessity definition
legal defense where a person breaks the law to prevent a greater harm or danger.
Compulsion/Duress definition
defence where person commits a crime because they were forced
Provocation definition
when a person is provoked by another’s actions which leads them to lose self control and commit crime.
Aboriginal or treaty rights definition
the rights of Indigenous peoples to land, resources, and self-governance, protected by law.
Mistake of law definition
when someone breaks the law without knowing it’s illegal and it’s usually not a valid defense.
ex you smoke weed thinking it’s allowed but it wasn’t
Mistake of fact definition
when someone commits an act based on a false belief about a fact. can sometimes be a valid defense.
ex you steal a bag that looks like yours but you didn’t know
Alibi definition
person proves they were somewhere else when the crime happened
Entrapment definition
law enforcement tricks or pressures someone into committing crime they wouldn’t have otherwise committed.
Automatism definition (non insane)
caused by an external factor like sleepwalking or a head injury. If successful it can lead to a full clearing.
Double jeopardy definition
when a person is tried twice for the same crime, which is prohibited by law.
