A

It restricts the scope of permitted development rights either in relation to a particular area or site. In there areas, a planning application may be required for work that would otherwise be permitted development.

What is an urgent works notice?

A

It allows local authorities to request the owner of the listed building to undertake repairs. If these are not undertaken the local authority make undertake the necessary urgent repairs to make the building weathertight, safe from collapse or to prevent vandalism and theft. The costs can be recovered from the owner.

This is distinct from a repairs notice which is concerned with long-term conservation.

What is a repairs notice?

A

A repairs notice is the first step in the compulsory purchase process. It is served by the local authority and specified those works it considers necessary for the proper preservation of the building.

If no works are undertaken after 2 months then the compulsory purchase proceedings commence.

A

Local authorities have power to compulsorily acquire a listed building if necessary for their long term preservation.

The building must be in disrepair and the owner must show unwilling or unable to carry out the repairs themselves.

The owner has 28 days to appeal.
