Seizing and impounding vehicles for 28 days.
When MUST you seize and impound for 28 days?
- They were disqualified from holding or obtaining a DL.
- They had a suspended or revoked DL.
- They were not holding a DL - eg. expired or never had one - AND have been previously forbidden to drive.
- Are found with breath alcohol over 400mcg AND have two previous convictions for any ‘relevant offense within the last four years.
- Are found with breath alcohol over 80mgm AND have two previous convictions for any ‘relevant offense within the last four years.
- They have failed or refused a blood test.
How long can you seize a vehicle under S.122? What for? LTA98
12 hours. For public safety.
