Section 136 - removal of a mentally disordered person without a warrant to a place of safety so they can be examined by a medical practitioner
Section 135(1) - entering premises to remove a person to a place of safety
Section 135(2) - Warrant ordering a person to be detained
Mental disorder definition
Any disorder or disability of the mind
Learning disability definition
State of arrested or incomplete development of the mind, creating significantly impairment in intelligence and social functioning
How long can you detain a mentally disordered person without a warrant to a place of safety so they can be examined by a medical practitioner (Section 136 Mental Health Act 1983)

Where and how should you take someone being detained under Section 136 Mental Health Act 1983
Not police station unless no other option
Place of safety - normally 136 suite at hospital
Ambulance unless violent, dangerous or extremely urgent then use police vehicle + paramedic should accompany
Considerations when detaining someone under S136 Mental Health Act 1983
○ Must consult a medical professional before
○ Force can be used to enter
○ Can search them if have reasonable grounds they are a danger or concealing an item on them which could be used to cause harm to themselves or others. Can search someone’s mouth
○ If crisis care plan in place, try to follow this instead of detaining under S136, unless deemed necessary
○ If have committed an offence, can still arrest
S136 can be used in custody
Why would you use S136 Mental Health Act 1983
Person needs to be in immediate need of care and control
Necessary because it’s in their interest or for someone else’s protection
Where can’t you use S136 Mental Health Act 1983
Their own or anyone else’s house
Children and S136 Mental Health Act 1983
Any age can be detained but NEVER use police station as place of safety
Consider police protection order instead
Why would you use S135(1) Mental Health Act 1983?
For assessment and compulsory admission to hospital
Person has been or is being subjected to a number of concerns or ill-treatment by others
If person is AWOL

Can search home and person
Warrant needed from magistrates court
Must be accompanied by AMHP
Assessment may take place on premises if granted permission. If sole occupier only their permission needed, if joint, need permission of at least one other occupier as well
Section 135(2) Mental Health Act 1983
Warrant ordering person to be detained
Mental Capacity Act 2005
Intervening in the decision making of a person aged 16 or over who lacks the capacity to make decisions for themselves
Must be emergency situation - attempting/threatening suicide, refusing medical care and deem ed to not have capacity to make decision
