What is the purpose of the MHA
Keep patients in hospital against their wishes for the assessment and treatment of mental health disorders
What is voluntary/informal admission
When someone with capacity agrees to be admitted to hospital voluntarily
Who are the people involved in the MHA
- AMHP
- Section 12 doctor
- Responsible clinician
- Nearest relatvie
- IMHA
What is the role of AMHP
Helps organise and primarily controbutes to MHA assessments
What is a section 12 doctor
Qualified and approved doctor who can undertake a MHA assessment
What does the responsible clinician do?
Person with overall resposibility for patient’s care
Usually a consultant
What does an IMHA do
Independent person allocated to a patient being detained under MHA - they support the person. help them uderstand the situation and express themselves
What happens in a MHA assessment - who is involved?
- Evaluation to see whether to detain someone under the MHA
- AMHP or nearest relative is making the application and organising the admission
- Decision needs to be recommended by 2 doctors, one of whom needs to be section 12 approved
What can a MHA Assessment result in?
Compulsory admission under section 2 or 3
What is section 2
- Compulsory admission for assessment following MHA assessment
- Lasts up to 28 days
- Cannot be renewed - ends in discharge or detention under section 3
What is section 3
- Compulsory admission for treatment
- Lasts up to 6 months, after which it can be rennewed by responsible clinician
When is section 3 applied?
Usually after a section 2, except for patients well known to MHS; they may be detained immediately under section 3 from the community
What is section 4
- Detain patients for up to 72 hours in urgent scenarios when other proedures can’t be arranged in time
Who is needed for section 4
Needs AMHP and one doctor, typically followed by MHA assessment
What is a section 5(2)
- Detain patients who are admitted to hospital voluntarily
- Lasts up to 72 hours
- Needs 1 doctor
Allows for a following MHA assessment
What is a section 5(4)
Nurses holding power - same as 5(2) however requires 1 nurse and only lasts up to 6 hours
Allows for a following MHA assessment
What is a section 136
- Used by police to remove someone with a mental health disorder from a public space and then take them to a place of safety where they can be assessed
- Lasts up to 24 hours
