The Family Educational Rights and Privacy Act of 1974 (FERPA)
ensures privacy protections for students and their education records. This includes academic, disciplinary and financial records and applies to all education institutions that receive federal funding.
FERPA has four key components
Notice, consent, access and correction, and security and accountability
FERPA Notice:
Students should receive annual notices of their rights
Education records are directly related to students and include academic, disciplinary and
financial information that has been recorded in hard copy or electronic form
FERPA Consent:
Disclosure of education records is permitted if one of the following is met:
• Information is not personally identifiable
• Directory information that has not been blocked by the student
• Consent has been given by the parent or student once they are 18 years old
• Disclosure is to a student or parent (if the student is under 18 or the student has consented)
• Statutory exception applies, such as health or safety purposes
The Protection of Pupil Rights Amendment (PPRA)
provides rights to parents of minors regarding sensitive information from students via surveys.
The No Child Left Behind Act of 2001 (or NCLBA)
broadened the PPRA by putting requirements on schools to enact collection, disclosure or use policies regarding personal information about students for commercial purposes, to give notice to parents with ample time for review and to provide an opt-out option regarding survey information.
