Community Payback Orders (CPOs) serve as a crucial component of community justice,
ensuring that offenders are held accountable while also being supported in addressing the underlying social, economic, and personal factors contributing to their criminal behaviour.
CPOs typically involve
a combination of elements, such as up to 300 hours of unpaid work benefiting the community, working with a social worker to reduce reoffending, paying compensation to victims, attending educational programmes, and receiving mental health or drug treatment through Drug Treatment and Testing Orders (DTTOS). These measures are often both cost-effective and rehabilitative.
According to Hamza Yousaf, speaking to the BBC in 2020,
“Unpaid work completed by people serving CPOs benefits local projects and helps them to become active and responsible contributors to their community.” He also emphasised that structured community sentences with supervision help individuals make the necessary positive changes to address the root causes of their behaviour.
Data from the Scottish Government further reinforces the effectiveness of CPOs.
The successful completion rate for CPOs in 2023-24 was 71% and 78% of these orders were completed without any breach applications. These figures suggest that CPOs are not only a viable alternative to imprisonment but also a largely successful means of addressing criminal behaviour within the community.
Similarly, in Ireland, Community Service Orders (CSOs) function as the equivalent to CPOs.
In 2019, Ireland’s Minister for Justice and Equality described CSOs as “a very valuable part of the criminal justice system, allowing an offender—where appropriate—to repay their debt to society.”
a study by the Irish Probation Service found that
the recidivism rate for offenders given CSOs was 32.7% within two years, significantly lower than the 58.3% recidivism rate for those who had served prison sentences.
The comparison between Scotland and Ireland illustrates the broader effectiveness of community-based sentences.
Both cases highlight how structured community justice programmes provide tangible benefits by reducing recidivism and promoting social reintegration. In contrast to prison sentences, which can sever social ties and contribute to a cycle of reoffending, CPOs and CSOs offer a more constructive alternative that balances accountability with rehabilitation. The data suggests that such approaches not only reduce crime in the long term but also foster more engaged and responsible individuals within society.
