A
costs order made in favour of/against a non-party.

what is the procedure?
A
The non-party must be:
o Added as a party (for costs purposes only) +
o Given a reasonable opportunity to attend the hearing when the matter will be considered

what are the key case law principles?
A
o Granted in exceptional circumstances
o Is it just to make the order?
o The fact someone funded proceedings generally insufficient - did they also have a real interest in litigation?
o Not intended to capture family and friends
