Filling Out the Journal
A
- Typically notary fee is $15 for acknowledgements and jurats
- Date and time
- Notary type (acknowledgment or jurat – two types)
- Type of document (character of the instrument) – name of the document
- Signer’s name and address
- Signer ID, DL/ID#, Issuing Agency (DMV, etc…), Exp. Date
- Signer’s Signature
- Additional information
- Signer’s thumbprint

When are thumbprints required for the notary journal?
A
- Deed
- Quitclaim deed
- Deed of trust
- Real property
- Power of attorney
- If you fail to do so, $25,000 fine

Thumbprints Exception
A
- Deed of reconveyance
- Trustee’s Deed (resulting from a foreclosure)
- Deed of trust NOT EQUAL to a trustee’s deed

Photocopy of Journal
A
- Any member of the Public may request a copy of the Journal
- In writing
- Name of the document
- Name of the signers
- Month/Year
- Respond within 15 days - Just make a copy of the specific line and cover the other items
- Can charge $.30 per line item

Lost or Stolen Journal
A
- If lost, stolen, misplaced, destroyed, damaged, unusable, immediately notify Secretary of State advising of this
- Certified or Registered Mail (Receipt)
- Journal Dates
- Commission #
- Commission Exp. Date
- Police Report
- Can never use that journal again once that journal is declared lost

Surrender Journal To Peace Officer
A
- Comply immediately
- If not, $2,500 fine
- Get receipt for journal from Peace Officer
- Send letter Certified/Registered mail within 10 days to Secretary of State and include receipt
- Start a new journal
