What happens to the family member if the citizen dies?
A
Article 17(4) of Directive 2004/38 says family members may acquire the right to permanent residence in less than 5 years if:
- they resided in the host state for at least two years
- death resulted in an accident at work

What rights do family members have?
A
- to enter and reside in e same state as the citizen
- employment in that state (Article 23 of Directive 2004/38)
- equal treatment with nationals of that state (Article 24 of Directive 2004/38)
These rights are conferred irrespective of nationality.

If you reside in a member state as a non-EUcitizen with your partner, can you take up work in another member state and leave your partner in the current one?
A
No (Mattern) it must’ve in the state the citizen is in.
